कौन से मामलों में जीएसटी पंजीकरण लेना अनिवार्य है ?

अधिनियम की धारा 24 के अनुसार निम्नलिखित वर्गों के व्यक्तियों को  अनिवार्य रूप से पंजीकृत लेना होगी;

  • व्यक्ति जो किसी प्रकार की अंतर-राज्य कराधीन आपूर्ति कर रहें हैं;
  • अस्थायी कराधीन व्यक्ति;
  • वे व्यक्ति जिन्हें रिवर्स प्रभार के अंर्तगत कर भुगतान करना आवश्यक है,
  • गैर निवासी कर योग्य व्यक्ति (Non-Resident Taxable Person)
  • व्यक्ति जो धारा 51 के अंतर्गत कर कटोती हेतु उत्तरदायी हो ।
  • व्यक्ति जो अन्य पंजीकृत कर योग्य व्यक्तियों की ओर से वस्तुओं और या सेवाओं की आपूर्ति करते हैं, चाहे एजेन्ट को रूप या अन्य ।
  • इनपुट सेवा वितरक (चाहे अधिनियम के अन्तर्गत अलग पंजीकृत है या नहीं)
  • व्यक्ति जो धारा 52 के अन्तर्गत कर एकत्र (Tax Collection at source) करने हेतु अपेक्षित हे ।
  • प्रत्येक इलेक्ट्रॉनिक वाणिज्य ऑपरेटर
  • धारा 9 की उपधारा (5) के अन्तर्गत दर भुगतान हेतु उत्तरदायी इलेक्ट्रॉनिक कॉमर्स ऑपरेटर,
  • भारत में एक पंजीकृत व्यक्ति के अलावा, प्रत्येक व्यक्ति जो भारत के बाहर से भारत में किसी व्यक्ति को ऑनलाइन जानकारी और डाटाबेस पुर्न प्राप्ति सेवाओं की आपूर्ति करता है।
  • ऐसे अन्य व्यक्ति या व्यक्तियों का वर्ग जिसे केन्द्र सरकार या राज्य सरकार परिषद को सिफारिश पर अधिसूचित किया जाता है।

 Section 24. Compulsory registration in certain cases.-

Notwithstanding anything contained in sub-section (1) of section 22, the following categories of persons shall be required to be registered under this Act,-

(i) persons making any inter-State taxable supply;

(ii) casual taxable persons making taxable supply;

(iii) persons who are required to pay tax under reverse charge;

(iv) person who are required to pay tax under sub-section (5) of section 9;

(v) non-resident taxable persons making taxable supply;

(vi) persons who are required to deduct tax under section 51, whether or not separately registered under this Act;

(vii) persons who make taxable supply of goods or services or both on behalf of other taxable persons whether as an agent or otherwise;

(viii) Input Service Distributor, whether or not separately registered under this Act;

(ix) persons who supply goods or services or both, other than supplies specified under sub-section (5) of section 9, through such electronic commerce operator who is required to collect tax at source under section 52;

(x) every electronic commerce operator 1[who is required to collect tax at source under section 52;]

(xi) every person supplying online information and database access or retrieval services from a place outside India to a person in India, other than a registered person; and

(xii) such other person or class of persons as may be notified by the Government on the recommendations of the Council.
